Install and update self-hosted EZproxy

This is an addendum to your current EZproxy Terms and Conditions. You will need to agree to the Terms and Conditions provided before downloading any software or updates.

By clicking “I Accept” below, You agree to the following Terms and Conditions:

1. OCLC Programs.

This Agreement governs Your download and use of an update to Your EZproxy software (the “OCLC Software”) and modifies the existing License Agreement between OCLC and You governing the sale and use of the OCLC Software. The OCLC Software Update includes security updates for EZproxy as described below.

2. License.

OCLC hereby grants to You a nonexclusive, nontransferable and non-assignable license to load and use the OCLC Software Update in object code form only, and solely for Your internal, noncommercial purposes. Otherwise, Your use of the OCLC Software Update will be governed by the terms and conditions of the Existing Agreement. At Institution’s election, and upon enablement by the Institution’s EZproxy administrator, OCLC will create a Security Identifier, consisting of an alphanumeric string of characters that will pseudonymously identify each individual patron that uses the OCLC Software, and OCLC will attach it to each request made by that patron through the OCLC Software to an EZproxy authorized content provider. This Security Identifier, which only pseudonymously  identifies a patron, is Personal Data as defined under the European Union’s General Data Protection Regulation (“GDPR”). A new, unique Security Identifier will be created by OCLC for each individual patron on the first of each calendar month, and the previous month’s Security Identifier will be permanently deleted by OCLC after two (2) calendar months. OCLC and the authorized content provider will only use the Security Identifier for the purpose of identifying potential compromised usage. You may deactivate the Security Identifier at any time through the OCLC Software’s control features. As the Security Identifier is Personal Data, its transfer and use will be governed by the OCLC Data Processing Agreement found at https://policies.oclc.org/en/privacy/data-privacy-agreements.html, which terms and conditions are incorporated herein by reference and hereby agreed to and accepted by the parties.

For avoidance of doubt, by accepting these Terms and Conditions, You agree to activate the Security Identifier for use as described above. You may deactivate the Security Identifier at any time through the OCLC Software’s control features.

3. Update Policy.

OCLC may, but is not obligated to, update the OCLC Software from time to time and will continue to make such updates available electronically. In general, updates will be announced by OCLC, and You will have an opportunity to acquire updated materials and interim patches from OCLC. OCLC will not be obligated to maintain compatibility for any prior versions of the OCLC Software after an updated version is made available. If You obtain the updated OCLC Software, the terms of the Existing Agreement will continue to govern the use of such updated OCLC Software. OCLC will make a general announcement electronically if it decides to terminate the right to use the copy of the preceding version of the OCLC Software.

4. Entire Agreement.

In the event of a conflict between the terms of the Existing Agreement and these Terms and Conditions, the terms of these Terms and Conditions will prevail and control. All remaining terms and conditions set forth in the Existing Agreement remain unchanged, in full force and effect and binding upon the Parties, except as modified by the terms herein.
